Terms of Service for AirChat

1. Agreement to Terms

By downloading, installing, or using AirChat (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("you," "your," or "User") and BinaryScript ("we," "us," "our," or "Company").

1.1 Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App after modifications constitutes acceptance of the updated Terms.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years of age to use AirChat. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

2.2 Account Requirements

To use AirChat, you must:

• Have a valid Google account
• Agree to these Terms and our Privacy Policy
• Provide accurate and complete information during registration
• Maintain the security and confidentiality of your account credentials

3. Description of Service

3.1 Service Overview

AirChat is a peer-to-peer local network messaging application that enables users to:

• Send and receive text messages
• Share photos, videos, and documents
• Send voice messages
• Discover other users on the same WiFi network
• Communicate without internet connectivity (after initial authentication)

3.2 Local Network Dependency

AirChat requires all users to be connected to the same WiFi network for communication. We are not responsible for:

• WiFi network availability or performance
• Network security or configuration
• Firewall or router restrictions
• Internet service provider policies

4. User Conduct and Responsibilities

4.1 Acceptable Use

You agree to use AirChat in a lawful, ethical, and responsible manner. You will:

• Comply with all applicable laws and regulations
• Respect the rights and privacy of other users
• Use the App for its intended purpose
• Report abuse or violations to us

4.2 Prohibited Conduct

You may NOT use AirChat to:

Illegal Activities:

• Violate any local, state, national, or international law
• Engage in or promote illegal activities
• Infringe on intellectual property rights
• Commit fraud, identity theft, or impersonation

Harmful Content:

• Transmit harmful, threatening, abusive, or hateful content
• Harass, bully, stalk, or intimidate other users
• Share obscene, pornographic, or sexually explicit content
• Promote violence, self-harm, or dangerous activities
• Distribute malware, viruses, or malicious code

Spam and Abuse:

• Send unsolicited advertisements or spam
• Engage in phishing or social engineering
• Flood or disrupt the service with excessive messages
• Use the App for commercial solicitation without permission

Privacy Violations:

• Share others' personal information without consent
• Intercept or monitor others' communications
• Attempt to access others' accounts or data
• Collect user information for unauthorized purposes

5. No Content Moderation

5.1 User Responsibility

Because AirChat is unmoderated, you must:

• Exercise caution when communicating with strangers
• Report inappropriate behavior to us at [email protected]
• Use blocking features when available
• Supervise minors using the App (if you are a parent/guardian)
• Use the App on trusted WiFi networks only

6. User Content

6.1 Your Content

"User Content" means any text, images, videos, audio, files, or other materials you create, upload, share, or transmit through AirChat.

6.2 Ownership and Responsibility

You retain all ownership rights to your User Content. However, you are solely responsible for:

• The accuracy, quality, and legality of your User Content
• The means by which you acquired your User Content
• Compliance with laws regarding your User Content

6.3 License to Company

By sharing User Content through AirChat, you grant us a limited license to:

• Store your User Content temporarily for service operation
• Transmit your User Content to intended recipients
• Display your User Content to users you communicate with

Important: We do not store your messages or media on our servers. This license is limited to facilitating peer-to-peer communication.

7. Security Limitations

7.1 Unencrypted Transmission

You acknowledge and accept that:

• AirChat messages are NOT encrypted during transmission between devices
• Anyone on the same WiFi network with technical skills could potentially intercept messages
• We are working on implementing end-to-end encryption in future updates
• You should only use AirChat on trusted, secure networks

7.2 Security Recommendations

For maximum security, we recommend:

• Using AirChat on private, password-protected WiFi networks
• Avoiding use on public WiFi (coffee shops, airports, etc.)
• Not sharing sensitive personal or financial information
• Keeping your device and App updated
• Using device lock screens and encryption

8. Future Premium Features

8.1 Premium Services

We may offer optional paid subscription plans ("Premium Services") in the future, which may include:

• Group chat with multiple participants
• Enhanced file sharing and storage
• Priority customer support
• Advanced features and customization
• Ad-free experience (if ads are introduced)

8.2 Billing and Renewal

Subscriptions operate as follows:

• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Billing Cycle: Monthly or annual (as selected)
• Payment Method: Charged to your Google Play or Apple account

8.3 Cancellation

You may cancel your subscription at any time:

• Android: Google Play Store > Subscriptions > AirChat > Cancel
• iOS: Settings > [Your Name] > Subscriptions > AirChat > Cancel

Cancellation takes effect at the end of the current billing period. No refunds for partial months or unused features.

8.4 Refunds

Refunds are handled according to Google Play and Apple App Store policies. We generally do not provide refunds except as required by law or in cases of technical issues preventing service access.

9. Disclaimers and Warranties

9.1 "AS IS" Service

AirChat IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY
• UNINTERRUPTED OR ERROR-FREE OPERATION

9.2 Use at Your Own Risk

YOU ACKNOWLEDGE THAT:

• You use AirChat at your own risk
• We are not responsible for content shared by other users
• Messages are not encrypted during transmission
• Your data may be vulnerable on unsecured networks
• We cannot guarantee protection against malicious users

10. Limitation of Liability

10.1 Damages Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINARYSCRIPT SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
• LOSS OF GOODWILL OR REPUTATION
• DAMAGES RESULTING FROM USER CONDUCT OR CONTENT
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT

10.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF AirChat SHALL NOT EXCEED:

• THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM, OR
• $100 USD, WHICHEVER IS GREATER

11. Indemnification

You agree to indemnify, defend, and hold harmless BinaryScript from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of AirChat
• Your violation of these Terms
• Your violation of any law or third-party rights
• Your User Content
• Your conduct or interactions with other users

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

• Deleting your account through the App settings (future feature)
• Emailing [email protected] with a termination request
• Uninstalling the App (does not delete backend account data)

12.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms or our policies
• You engage in illegal or harmful conduct
• We are required to do so by law
• We decide to discontinue the service

12.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• We may delete your account data after 90 days (see Privacy Policy)
• Data on your device remains until you uninstall the App

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BinaryScript regarding AirChat.

13.2 Governing Law

These Terms are governed by:

• International users: Laws of your country of residence
• US users: Laws of the State of Delaware

13.3 Time Limitation

Claims must be filed within one (1) year from when the cause of action arose. Claims filed after one year are permanently barred.
