Terms of Service - Background Camera Recorder

Please read these Terms of Service ("Terms") carefully before using Background Camera Recorder ("the App") operated by BinaryScript ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

1.1 Eligibility

You must be at least 13 years of age to use the App. By using the App, you confirm that you meet this requirement.

1.2 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal Android device for your personal, non-commercial purposes, subject to these Terms.

1.3 Acceptable Use

You agree to use the App only for lawful purposes. You are solely responsible for all recordings you create using the App. You agree NOT to use the App to:

  • Record individuals without their knowledge or consent where required by law
  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon the privacy rights of others
  • Create content that is illegal, defamatory, obscene, or otherwise objectionable
  • Engage in surveillance or monitoring activities that violate applicable laws
1.4 Legal Compliance

Recording laws vary by jurisdiction. Some regions require the consent of all parties being recorded (audio and/or video). It is your sole responsibility to understand and comply with all applicable recording and privacy laws in your location. We do not provide legal advice and assume no liability for your use of the App.

2. Subscriptions and Payments

2.1 Premium Features

Certain features of the App require an active premium subscription or a one-time lifetime purchase. Free users may have limited access to features as determined by us.

2.2 Subscription Plans

We offer the following plans through Google Play:

  • Monthly subscription
  • Yearly subscription
  • Lifetime purchase (one-time payment)
2.3 Billing

All payments are processed through Google Play Billing. By purchasing a subscription or lifetime plan, you agree to Google Play's Terms of Service. We do not directly handle your payment information.

2.4 Auto-Renewal

Monthly and yearly subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription through your Google Play account settings.

2.5 Refunds

Refund requests are handled by Google Play in accordance with their refund policy. We do not process refunds directly. You may request a refund through Google Play within the applicable refund window.

2.6 Price Changes

We reserve the right to change subscription pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle following notice of the change.

2.7 Demo Access

New users may receive a limited demo period to try the App. Demo access is provided at our discretion and may be modified or discontinued at any time.

3. Recordings and Content

3.1 Ownership

You retain full ownership of all video and audio recordings created with the App. We do not claim any rights over your recordings.

3.2 Local Storage

All recordings are stored locally on your device. We do not upload, access, view, or store your recordings on any server. You are responsible for managing your device storage and backing up your recordings.

3.3 Sharing

When you share recordings through the App, the content is sent directly from your device to the destination app or service you select. We have no control over how third-party apps handle your shared content.

3.4 Deletion

You can delete recordings at any time through the App's gallery. The App also offers auto-cleanup settings that can automatically remove recordings based on age or storage limits you configure. Deleted recordings cannot be recovered.

4. Intellectual Property

4.1 App Ownership

The App, including its design, code, features, graphics, and branding, is owned by BinaryScript and protected by intellectual property laws. These Terms do not transfer any ownership rights to you.

4.2 Restrictions

You may not:

  • Copy, modify, or distribute the App or any part of it
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any proprietary notices or labels
  • Use the App's name, logo, or branding without our written permission
  • Resell, sublicense, or commercially exploit the App

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or free of harmful components
  • Recordings will be saved successfully in all circumstances
  • The App will be compatible with all devices or operating system versions
  • Background recording will function continuously without interruption due to device limitations, battery management, or operating system restrictions

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BINARYSCRIPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of recordings or data
  • Recording failures or interruptions
  • Device storage issues
  • Battery drain or device performance impacts
  • Any damages arising from your use or inability to use the App

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to indemnify, defend, and hold harmless BinaryScript and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

  • Your use of the App
  • Your recordings or content created with the App
  • Your violation of these Terms
  • Your violation of any applicable law or the rights of any third party

8. Third-Party Services

The App integrates with third-party services including Google Play Billing, Firebase Analytics, Firebase Crashlytics, and Firebase Remote Config. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Termination

9.1 By You

You may stop using the App and uninstall it at any time. Uninstalling the App will delete all locally stored data.

9.2 By Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App is revoked.

9.3 Effect of Termination

Upon termination, you must cease all use of the App. Sections 3.1, 4, 5, 6, 7, and 10 shall survive termination.

10. General

10.1 Changes to Terms

We may update these Terms from time to time. Changes will be reflected by the "Last Updated" date at the top. Continued use of the App after changes constitutes acceptance of the updated Terms.

10.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

10.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full effect.

10.4 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BinaryScript regarding the use of the App.
