Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the Caller Announcer Pro mobile application (the "App") operated by BinaryScript ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you are at least 13 years old.

2. Description of Service

Caller Announcer Pro is a mobile application that announces the name of incoming callers using text-to-speech technology. The App provides the following features:

  • Announces caller names from your contacts when you receive incoming calls
  • Allows customization of announcement settings (volume, speech rate, language)
  • Provides a blocklist feature to exclude specific numbers from announcements
  • Offers Silent Zones feature to automatically mute announcements in specific locations
  • Displays advertisements to support the free service

The App requires certain device permissions to function properly, including access to contacts, call logs, phone state, and location (for Silent Zones).

3. User Responsibilities

By using the App, you agree to:

A. Compliance
  • Use the App in compliance with all applicable laws and regulations
  • Not use the App for any unlawful or prohibited purpose
  • Comply with all local laws regarding online conduct and acceptable content
B. Permissions
  • Grant necessary permissions for the App to function as intended
  • Understand that revoking certain permissions may limit App functionality
C. Acceptable Use
  • Not attempt to reverse engineer, decompile, or disassemble the App
  • Not modify, adapt, or create derivative works based on the App
  • Not attempt to bypass any security measures or access restrictions
  • Not use the App to harass, abuse, or harm others
  • Not interfere with or disrupt the App or servers connected to the App
D. Device Security
  • Maintain the security of your device
  • Notify us immediately if you become aware of any unauthorized use or security breach
4. Intellectual Property
A. Ownership

The App, including all content, features, functionality, design, and underlying technology, is owned by BinaryScript and is protected by copyright, trademark, and other intellectual property laws.

B. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device for your personal, non-commercial use.

C. Restrictions

You may not:

  • Copy, modify, or distribute the App or any part thereof
  • Sell, rent, lease, or sublicense the App
  • Use our trademarks, logos, or branding without written permission
  • Remove or alter any proprietary notices or labels on the App
5. Third-Party Services

The App integrates with third-party services including:

  • Google AdMob (advertising)
  • Firebase Analytics (usage analytics)
  • Firebase Crashlytics (crash reporting)
  • Google Play Services (location services)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

6. Advertisements

The App displays advertisements provided by Google AdMob. By using the App, you agree to view such advertisements. We do not endorse or guarantee any products or services advertised through the App.

7. Disclaimers
A. "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

B. No Warranty

WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected
  • The App will meet your specific requirements
C. Functionality Limitations
  • Caller name announcement accuracy depends on your contact list data
  • Text-to-speech quality may vary depending on your device and system settings
  • Silent Zones functionality depends on location accuracy and GPS availability
  • The App may not function properly if required permissions are not granted
D. Device Compatibility

We do not guarantee that the App will be compatible with all devices or operating system versions.

8. Limitation of Liability
A. Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BINARYSCRIPT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to or use of our services
  • Damages resulting from any third-party content or services
  • Any other damages arising out of your use of the App
B. Cap on Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APP (IF ANY) IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

C. Essential Purpose

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to defend, indemnify, and hold harmless BinaryScript and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of any applicable laws or regulations
10. Termination
A. By You

You may terminate your use of the App at any time by uninstalling it from your device.

B. By Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

C. Effect of Termination

Upon termination:

  • Your license to use the App will immediately cease
  • All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability
11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will notify users of material changes by updating the "Last Updated" date at the top of these Terms.

Your continued use of the App after any changes to these Terms constitutes your acceptance of such changes. If you do not agree to the modified Terms, you should discontinue use of the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Raipur, Chhattisgarh, India.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

14. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BinaryScript regarding the use of the App and supersede all prior agreements and understandings.
