Terms of Service for FlashAlerts

Please read these Terms of Service ("Terms") carefully before using the FlashAlerts mobile application (the "App") operated by Binaryscript Private Limited ("we," "us," or "our").

1. Acceptance of Terms

By accessing or using FlashAlerts, you confirm that:

• You have read, understood, and agree to be bound by these Terms
• You have read and agree to our Privacy Policy

If you are using the App on behalf of an organization, you agree to these Terms on behalf of that organization and represent that you have the authority to do so.

• Remove any copyright or proprietary notices from the App

We do not warrant that:

• The App will meet your specific requirements
• The App will be compatible with all devices
• Any errors in the App will be corrected
• The App will function without interruption

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP, WHICH IS ZERO (FREE).

We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of such services is at your own risk and subject to their respective terms.

The App may display advertisements from third parties. We do not endorse and are not responsible for the content of any advertisements or the products/services they promote.

9. Indemnification

You agree to defend, indemnify, and hold harmless Binaryscript Private Limited and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your license to use the App will cease
• You must uninstall and delete all copies of the App
• Provisions of these Terms that should survive termination will remain in effect

You may terminate your use of the App at any time by uninstalling it from your device.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in India.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision. Any waiver must be in writing and signed by us.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Binaryscript Private Limited regarding the use of the App and supersede any prior agreements.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. We will notify users of material changes by updating the "Last Updated" date at the top of these Terms.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.
