Terms of Service for RadarMap

Please read these Terms of Service ("Terms") carefully before using the RadarMap mobile application ("App") operated by Binaryscript Private Limited ("Company," "we," "us," or "our").

1. Acceptance of Terms

By accessing or using RadarMap, you confirm that:

• You are at least 18 years old, or the age of majority in your jurisdiction, OR you are at least 13 years old and have parental/guardian consent
• You have the legal capacity to enter into this agreement
• You will comply with all applicable laws while using the App

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

2. Description of Service

RadarMap is a speed camera detection and alert application that:

• Displays speed camera and traffic enforcement locations on a map
• Provides proximity alerts when approaching cameras
• Allows users to report camera locations and hazards
• Offers customizable alert modes (voice, sound, vibration, silent)
• Supports Android Auto integration

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice.

3. Important Disclaimers and Warnings

3.1 Accuracy Disclaimer

• We do NOT guarantee the App will detect all cameras or hazards
• We do NOT guarantee alerts will be delivered in time
• GPS accuracy, network conditions, and device performance may affect the App's functionality
• The App may not function in all geographic regions

4.1 Account Creation

• You may sign in using Google Sign-In
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access

4.2 Account Responsibilities

• You are responsible for all activities under your account
• Do not share your account credentials
• Do not create multiple accounts for abusive purposes
• Do not impersonate others or misrepresent your identity

4.3 Account Termination

• You may delete your account at any time
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the App ceases immediately

5. User-Generated Content

5.1 Camera Reports

When you submit camera reports or other content, you:

• Grant us a worldwide, royalty-free, perpetual license to use, modify, display, and distribute your submissions
• Confirm the information is accurate to the best of your knowledge
• Agree not to submit false, misleading, or malicious reports
• Understand your user ID is associated with your reports

5.2 Content Standards

You agree NOT to submit content that:

• Is false, inaccurate, or misleading
• Is intended to spam or abuse the reporting system
• Contains malicious data or attempts to exploit the App
• Violates any applicable laws or regulations
• Infringes on others' intellectual property rights

5.3 Community Voting

• Users may upvote or downvote camera reports
• Do not manipulate votes through fake accounts or coordinated abuse
• We reserve the right to remove reports that receive excessive downvotes or appear fraudulent

5.4 Content Moderation

• We may review, edit, or remove user-submitted content at our discretion
• We are not obligated to monitor all user content
• Report inappropriate content to [email protected]

6. Acceptable Use Policy

You agree to use RadarMap ONLY for lawful purposes and in accordance with these Terms.

6.1 Prohibited Activities

You shall NOT:

• Use the App to evade law enforcement or facilitate illegal activity
• Attempt to reverse engineer, decompile, or extract source code
• Circumvent security measures or access restricted areas
• Interfere with the App's operation or overload our servers
• Scrape, harvest, or collect data from the App without permission
• Use automated systems (bots) to interact with the App
• Resell, redistribute, or commercially exploit the App
• Transmit viruses, malware, or other malicious code
• Harass, abuse, or harm other users
• Submit false camera reports to mislead other users

6.2 Enforcement

Violation of this policy may result in:

• Warning or temporary suspension
• Permanent account termination
• Legal action where appropriate
• Reporting to law enforcement if criminal activity is suspected

7. Intellectual Property

7.1 Our Intellectual Property

• The App, including its design, features, code, graphics, and content, is owned by Binaryscript Private Limited
• "RadarMap" name and logo are our trademarks
• You may not copy, modify, or create derivative works without permission

7.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not include the right to sublicense or transfer your rights.

7.3 Third-Party Content

• Map data is provided by Mapbox and subject to their terms
• Camera data may originate from various sources including community contributions
• Third-party trademarks remain the property of their respective owners

8. Premium Features and Payments

8.1 Free and Premium Tiers

• RadarMap offers free features with advertisements
• Premium features may be available through subscription or one-time purchase
• Premium benefits may include ad-free experience and advanced features

8.2 Payments

• All payments are processed through Google Play Store
• Prices are listed in the App and may vary by region
• You agree to pay all applicable fees and taxes

8.3 Subscriptions

• Subscriptions automatically renew unless cancelled
• Cancel at least 24 hours before the renewal date
• Manage subscriptions through Google Play Store settings

8.4 Refunds

Refund requests are handled according to Google Play Store policies. Contact [email protected] for billing issues.

9. Privacy

Your use of RadarMap is also governed by our Privacy Policy.

By using the App, you consent to the collection and use of information as described in the Privacy Policy.

Key privacy points:

• Location data is processed locally and NOT stored on our servers
• Camera reports include your user ID
• We use Firebase for authentication and analytics
• We do not sell your personal information

10. Disclaimer of Warranties

WE DO NOT WARRANT THAT:

• The App will meet your specific requirements
• The App will be available at all times
• Results obtained will be accurate or reliable
• Any errors will be corrected

YOU ACKNOWLEDGE THAT:

• You use the App at your own risk
• You are solely responsible for obeying traffic laws
• The App is not a substitute for safe, legal driving

11. Limitation of Liability

This limitation applies to:

• Claims based on warranty, contract, tort, or any other legal theory
• Claims arising from App unavailability or malfunction
• Claims arising from inaccurate camera data or missed alerts

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Binaryscript Private Limited, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable laws
• Your violation of any third-party rights
• Content you submit through the App
• Traffic violations or accidents related to App use

We reserve the right to assume exclusive defense of any matter subject to indemnification, at your expense.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

13.2 Dispute Resolution

• Any disputes shall first be attempted to be resolved through informal negotiation

• We will attempt to resolve disputes within 30 days

13.3 Arbitration

If informal resolution fails:

• Disputes shall be resolved through binding arbitration
• Arbitration shall be conducted in Raipur, India
• Arbitration shall be in English language
• The arbitrator's decision shall be final and binding

13.4 Jurisdiction

For matters not subject to arbitration, you consent to the exclusive jurisdiction of courts in Raipur, India.

13.5 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

14. Termination

14.1 By You

• You may stop using the App and delete your account at any time
• Uninstalling the App terminates your license to use it

14.2 By Us

We may terminate or suspend your access immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your use poses a security risk
• Required by law or court order
• We discontinue the App

14.3 Effect of Termination

• Your license to use the App ends immediately
• Provisions that should survive termination will remain in effect (including disclaimers, limitations of liability, and indemnification)
• We are not liable for any termination of your access

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.

15.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

15.5 Force Majeure

We are not liable for failures due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, etc.).

• We may send notices via email, in-app notifications, or App updates
