PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP

1. Acceptance of Terms

1.1 Agreement to Terms

By downloading, installing, accessing, or using ShareMyWiFi (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1.2 Binding Agreement

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Binaryscript Private Limited ("Company," "we," "us," or "our") governing your use of the App.

1.3 Additional Terms

Your use of the App is also subject to:

• Our Privacy Policy (incorporated by reference)
• Google Play Store Terms of Service
• Third-party service terms (Firebase, Google, AdMob)

1.4 Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms. We will notify users of material changes via in-app notification or email.

1.5 Eligibility

You must be at least 13 years old to use this App. If you are under 18, you must have parental consent to use the App. By using the App, you represent that you meet these age requirements.

2. Description of Service

2.1 Service Provided

2.2 Local Storage

The App stores WiFi credentials (network names and passwords) locally on your device with encryption. WiFi passwords are NEVER uploaded to our servers or transmitted over the internet.

2.3 Free Service with Ads

ShareMyWiFi is provided free of charge and is supported by advertising. By using the App, you agree to view advertisements displayed within the App. Ad-free options may be offered in future versions.

2.4 Service Availability

• The App is provided on an "as is" and "as available" basis
• We do not guarantee uninterrupted or error-free service
• The App may be temporarily unavailable due to maintenance, updates, or technical issues
• We reserve the right to modify, suspend, or discontinue the App at any time without notice

3. User Eligibility and Accounts

3.1 Age Requirements

• Users must be at least 13 years old
• Users under 18 must have parental or guardian consent
• We comply with COPPA (Children's Online Privacy Protection Act)

3.2 Google Sign-In (Optional)

• Some features require Google Sign-In authentication via Firebase
• You are responsible for maintaining the security of your Google account
• You must provide accurate and current information
• You may not use another person's account without permission
• You must notify us immediately of any unauthorized account access

3.3 Account Termination

We reserve the right to suspend or terminate your access to the App if you violate these Terms, engage in prohibited activities, or for any other reason at our sole discretion.

4. User Responsibilities

4.1 Lawful Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must comply with all applicable local, state, national, and international laws and regulations.

4.2 Network Ownership and Authorization

• You are responsible for ensuring WiFi credentials you enter are accurate
• Incorrect credentials may prevent others from connecting
• We are not responsible for connection failures due to incorrect information

4.4 Device Security

• You are responsible for securing your device
• Use device lock screens and encryption to protect stored WiFi credentials
• Do not allow unauthorized access to your device
• Report lost or stolen devices immediately and clear app data remotely if possible

4.5 Reasonable Use

• Use the App in a reasonable and responsible manner
• Do not abuse, overload, or interfere with the App's operation
• Do not attempt to circumvent security measures or access restrictions

5. Prohibited Activities

You agree NOT to:

5.1 Illegal Activities

• Use the App for any illegal purpose or in violation of any laws
• Share credentials for networks you do not own or are not authorized to share
• Use the App to gain unauthorized access to networks
• Violate any computer crime or hacking laws

5.2 Misuse of Service

• Reverse engineer, decompile, disassemble, or attempt to derive source code of the App
• Modify, adapt, translate, or create derivative works of the App
• Remove, obscure, or alter any copyright, trademark, or proprietary notices
• Use automated systems (bots, scrapers) to access the App
• Interfere with or disrupt the App's servers or networks

5.3 Harmful Activities

• Transmit viruses, malware, or malicious code
• Attempt to gain unauthorized access to App systems or user accounts
• Use the App to harm, harass, or violate rights of others
• Impersonate any person or entity

5.4 Commercial Misuse

• Sell, rent, lease, or commercialize the App without authorization
• Use the App for unauthorized commercial purposes
• Remove or circumvent advertisements without authorization

5.5 Violation of Third-Party Rights

• Infringe copyrights, trademarks, patents, or other intellectual property rights
• Violate privacy rights or data protection laws
• Breach any third-party terms of service (ISP, network provider, venue WiFi terms)

5.6 Network Abuse

• Share credentials for networks that explicitly prohibit sharing
• Use shared credentials to engage in illegal activities or violations of network terms
• Share credentials in a manner that compromises network security

Violation of these prohibitions may result in immediate termination of your access to the App and potential legal action.

6. Intellectual Property Rights

6.1 Ownership

ShareMyWiFi, including all content, features, functionality, code, design, graphics, logos, and trademarks, is owned by Binaryscript Private Limited and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 License Grant to You

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Download and install the App on your personal devices
• Use the App for personal, non-commercial purposes
• Create and share WiFi QR codes for networks you own or are authorized to share

6.3 License Restrictions

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Create derivative works based on the App
• Remove any proprietary notices or labels
• Transfer, sell, or sublicense the App to others

6.4 User-Generated Content

• WiFi credentials and custom labels you create remain your property
• You grant us a license to store and process this data locally on your device to provide App functionality
• We do not claim ownership of your WiFi credentials or user-generated content

6.5 Trademarks

"ShareMyWiFi" and associated logos are trademarks of Binaryscript Private Limited. You may not use these trademarks without our prior written consent.

6.6 Third-Party Intellectual Property

• The App uses third-party libraries and services (Flutter, Firebase, Google services)
• These third parties retain all rights to their intellectual property
• Your use of the App does not grant you any rights to third-party intellectual property

6.7 Feedback

If you provide feedback, suggestions, or ideas about the App, we may use them without any obligation to compensate you. You assign all rights in such feedback to us.

7. Privacy and Data

7.1 Privacy Policy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.

7.2 Data Collection

We collect and process data as described in our Privacy Policy, including:

• WiFi network names (stored locally only)
• WiFi passwords (encrypted, stored locally only, NEVER uploaded)
• Device information and analytics via Firebase
• Google Sign-In information if you choose to authenticate

7.3 Local Data Storage

• WiFi credentials are stored locally on your device with encryption
• You are responsible for backing up your device if you want to preserve saved networks
• We are not responsible for data loss due to device failure, app uninstall, or other causes

7.4 No Cloud Backup

• We do not provide cloud backup of WiFi credentials
• Passwords are stored locally only for your security and privacy
• Uninstalling the App will delete all locally stored data

7.5 Third-Party Data Processing

• Firebase (Google) processes analytics, crash reports, and authentication data
• Ad networks (AdMob) process advertising data
• Review third-party privacy policies for details on their data practices

8. Third-Party Services

8.1 Third-Party Integration

The App integrates with third-party services including:

• Firebase Authentication (Google Sign-In)
• Firebase Analytics (usage analytics)
• Firebase Crashlytics (crash reporting)
• Google Play Services
• AdMob (ad serving)

8.2 Third-Party Terms

Your use of these third-party services is subject to their respective terms of service and privacy policies:

8.5 Links to Third-Party Sites

The App may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of linked sites.

9. Disclaimers and Warranties

9.1 No Guarantee of Accuracy

• We do not guarantee that WiFi QR codes will work with all devices
• We do not guarantee that NFC writing will work with all NFC tags
• We do not guarantee successful WiFi connections using shared credentials
• We are not responsible for incorrect or outdated WiFi credentials

9.2 No Guarantee of Availability

• We do not guarantee the App will be available at all times
• We do not guarantee the App will be error-free or uninterrupted
• We may modify, suspend, or discontinue the App at any time

9.3 No Guarantee of Security

• While we implement security measures, we cannot guarantee absolute security
• You are responsible for securing your device
• We are not liable for unauthorized access to data on your device

9.4 No Guarantee of Compatibility

• We do not guarantee the App will work with all devices, operating systems, or versions
• We do not guarantee compatibility with all WiFi routers or network configurations
• We may discontinue support for older devices or OS versions

9.5 Third-Party Reliability

• We are not responsible for the reliability or performance of third-party services (Firebase, Google, AdMob)
• Third-party service outages may affect App functionality

9.6 User Responsibility

9.7 No Professional Advice

The App does not provide legal, technical, or professional advice. Consult qualified professionals for advice specific to your situation.

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

10. Limitation of Liability

10.1 Specific Exclusions

We are not liable for:

• Data loss or corruption
• Device damage or malfunction
• Unauthorized access to networks
• Security breaches or data theft from your device
• WiFi connection failures
• Incorrect or outdated credentials
• Third-party service failures
• Network provider actions or policies
• Legal consequences of unauthorized credential sharing
• Costs incurred from network usage
• Business losses or lost profits
• Personal injury or property damage

10.2 Aggregate Liability Cap

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF (A) FIFTY DOLLARS ($50 USD) OR (B) THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS (WHICH IS ZERO FOR FREE USERS).

10.3 User Responsibility

You acknowledge that you use the App at your own risk. You are solely responsible for:

• Ensuring you have authorization to share WiFi credentials
• Compliance with applicable laws and network provider terms
• Securing your device and data
• Verifying accuracy of credentials before sharing
• Any consequences of sharing WiFi access

10.4 Essential Purpose

You acknowledge that these limitations of liability are an essential basis of the agreement between you and us, and that we would not provide the App without these limitations.

10.5 Jurisdictional Variations

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

11. Indemnification

11.1 Your Indemnification Obligation

You agree to indemnify, defend, and hold harmless Binaryscript Private Limited, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of any third-party rights (intellectual property, privacy, publicity, property rights)
• Your sharing of WiFi credentials without authorization
• Any unauthorized access to networks using credentials you shared
• Any content you create or share through the App
• Your breach of any representations or warranties made in these Terms
• Any negligent or wrongful conduct by you

11.2 Defense and Settlement

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses. You may not settle any claim without our prior written consent.

11.3 Notification

You agree to promptly notify us of any third-party claims related to your use of the App.

12. Termination

12.1 Termination by You

You may stop using the App at any time by uninstalling it from your device. Uninstalling will delete all locally stored data, including saved WiFi networks and credentials.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, for any reason including:

• Violation of these Terms
• Engaging in prohibited activities
• Illegal use of the App
• Security concerns
• Extended inactivity
• At our sole discretion

12.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ceases
• You must cease all use of the App and delete it from your devices
• All locally stored data will be deleted (or you may manually clear it)
• Provisions that by their nature should survive termination will survive (indemnification, disclaimers, limitations of liability, dispute resolution)

12.4 No Refunds

As the App is free, no refunds are applicable. If you purchase any paid features or services in the future, separate refund terms will apply.

12.5 No Liability for Termination

We are not liable to you or any third party for termination of your access to the App.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

13.2 Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or related to these Terms or the App shall be brought exclusively in the courts located in India. You consent to the personal jurisdiction of such courts and waive any objection to venue.

13.3 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. Provide a description of the dispute and your desired resolution. We will attempt to resolve the dispute within 30 days.

13.4 Arbitration (Optional)

If informal resolution fails, either party may elect to resolve the dispute through binding arbitration under Indian arbitration laws. Arbitration will be conducted in India and judgment on the arbitration award may be entered in any court having jurisdiction.

13.5 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US ONLY ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS AGAINST US.

13.6 Time Limitation

You must bring any claim against us within one (1) year after the cause of action arises, or the claim is permanently barred.

13.7 Exceptions to Arbitration

Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.

13.8 Severability of Dispute Resolution

If any provision of this dispute resolution section is found unenforceable, that provision shall be severed and the remainder of the section shall remain in effect.

14. Advertising

14.1 Ad-Supported Service

ShareMyWiFi is a free app supported by advertising. By using the App, you agree that we may display advertisements within the App.

14.2 Third-Party Ad Networks

Advertisements are served by third-party ad networks (AdMob/Google). These networks may collect data about your device and usage for ad targeting purposes. Review their privacy policies:

14.3 Ad Tracking

Ad networks may use:

• Advertising identifiers (Android Advertising ID)
• Device information (model, OS version)
• Usage data and ad interaction data

• We do not control the content of third-party advertisements
• We are not responsible for ad content, accuracy, or claims made in ads

14.7 Ad Blocking

You may not use ad blockers or modify the App to remove or circumvent advertisements. Doing so violates these Terms and may result in termination of your access.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Binaryscript Private Limited regarding the App and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them valid and enforceable.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.

15.4 Assignment

You may not assign, transfer, or sublicense these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

15.5 No Third-Party Beneficiaries

These Terms are for the benefit of you and Binaryscript Private Limited only. No third party has any right to enforce or benefit from these Terms.

15.6 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

15.7 Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

15.8 Electronic Communications

By using the App, you consent to receive electronic communications from us, including notices, agreements, and disclosures. You agree that electronic communications satisfy any legal requirement that communications be in writing.

15.9 Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations. You represent that you are not located in a country subject to embargo or designated as a "terrorist supporting" country, and that you are not on any prohibited or restricted party list.

15.10 Updates and Modifications

• We may release updates to the App from time to time
• Updates may add, modify, or remove features
• You are encouraged to install updates to receive bug fixes and security patches
• Continued use of outdated versions is at your own risk

15.11 Interpretation

• These Terms shall be interpreted in accordance with their plain meaning
• Any ambiguities shall not be construed against the drafting party
