Agreement to Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("User", "you", or "your") and Binaryscript Private Limited ("Company", "we", "us", or "our") concerning your access to and use of the Origami 3D mobile application (the "App").
BY DOWNLOADING, INSTALLING OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.
1. Eligibility
1.1 Age
The App is suitable for general audiences and contains no objectionable content, but it is not directed at children under 13. If you are under 18, you may use the App with the involvement of a parent or legal guardian, who accepts these Terms on your behalf.
1.2 Legal Capacity
By using the App you represent that you have the legal capacity to enter into this agreement, or that a parent or guardian has done so for you.
1.3 Compliance
You agree to comply with all applicable local, national and international laws in your use of the App.
2. Licence to Use the App
2.1 Grant of Licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download, install and use the App on devices you own or control, for your personal, non-commercial use.
2.2 Restrictions
You agree NOT to:
- Modify, adapt, translate or create derivative works of the App
- Reverse engineer, decompile, disassemble or attempt to derive the source code of the App, its 3D folding engine, or its lesson data files, except to the extent this restriction is prohibited by applicable law
- Extract, copy, republish or redistribute the App's lesson files, 3D fold data, animations, artwork or text, whether by automated means or otherwise
- Remove, alter or obscure any copyright, trademark or proprietary notice
- Rent, lease, lend, sell, sublicense or otherwise transfer the App to any third party
- Use the App for any illegal or unauthorised purpose
- Interfere with, disable or circumvent any security or access-control feature of the App
- Use the App in any way that could damage, disable or impair it
2.3 Ownership
The App and all intellectual property rights in it remain the exclusive property of Binaryscript Private Limited. These Terms grant you no rights to our trademarks, service marks or logos.
3. The App and Its Content
3.1 What the App Is
The App is a self-contained origami course. It presents a sequence of lessons, each showing a fold sequence animated in 3D, with written notes for each step. All lesson content, the 3D folding engine and the models are bundled with the App and work without an internet connection.
3.2 Free of Charge
The App is currently provided free of charge, with no advertising and no in-app purchases.
3.3 Traditional Models
The origami models taught in the App are traditional designs — folding sequences that have been passed down publicly and are not the copyrighted work of a known individual designer. The App's own presentation of them — the 3D fold data, the animations, the written step notes, the course structure and the artwork — is our original work and is protected by copyright.
If you believe the App teaches a model that is in fact a designer's copyrighted original, please write to [email protected] and we will investigate and, where appropriate, remove or credit it.
3.4 Incomplete Lessons
Some lessons are deliberately incomplete. The App's folding engine represents one straight crease at a time on flat paper; a small number of traditional models include a move it cannot represent honestly, and those lessons stop at that point rather than showing a fold that is not real. Such lessons are marked in the App. Other lessons may be shown as pending or coming soon. You accept the App as it is, including these limits, and we make no promise that any particular model will be added or completed.
3.5 Changes to the App
We may add, change, or remove lessons, models and features at any time. We may also discontinue the App entirely. We are not liable to you for any such change.
3.6 No Warranty of Availability
The App runs locally on your device and does not depend on our servers, but we do not guarantee that it will run on every device, in every configuration, or without interruption or error.
4. Future Paid Features
The App is free today. We may introduce optional paid features, a premium tier or subscriptions in a future version. If we do, the following will apply to those features, and the terms in force at the time of your purchase will govern it:
4.1 Billing
All purchases would be made and billed through Google Play or the Apple App Store. Payment is charged to your store account at confirmation of purchase.
4.2 Subscriptions
Any subscription would renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and can be managed and cancelled at any time in your store account settings. Cancellation takes effect at the end of the current billing period.
4.3 Price Changes
We may change prices. Changes apply to new purchases and, for subscriptions, to existing subscribers on their next renewal after reasonable notice.
4.4 Refunds
All purchases would be final and non-refundable. We do not process refunds directly; any refund granted for a store purchase is at Google's or Apple's sole discretion. Full details are set out in our Refund Policy, which forms part of these Terms.
4.5 No Effect on Existing Content
Introducing paid features will not remove lessons that were already available to you free of charge in a version of the App you have installed.
5. Your Data
5.1 No Account
The App has no account system, no sign-in and no text input. You do not submit any content to us and we hold nothing about you.
5.2 Local Progress
Your record of which lessons you have folded is stored on your own device only. It is not backed up to any server, it cannot be transferred to another device, and it cannot be recovered by us or by you once it is gone.
5.3 Data Loss
Clearing the App's data, uninstalling the App, or resetting progress within the App will permanently delete your progress. We are not liable for that loss, and we have no means of restoring it.
5.4 Analytics and Crash Reporting
The App sends anonymous usage statistics and crash reports, as described in our Privacy Policy. Your use of the App is also subject to that policy, which forms part of these Terms.
6. Rating Prompt
The App may ask the operating system to show you the store's own rate-this-app prompt, after you have completed at least one model. Whether that prompt appears is decided by Google Play or Apple, not by us, and we receive no information about what you do with it. You are never required to rate the App.
7. Prohibited Uses
You agree not to use the App:
- To violate any law or regulation
- To infringe the intellectual property rights of others
- To transmit viruses, malware or malicious code
- To extract or scrape its lesson data, fold sequences or 3D content
- To build, train or improve a competing product or dataset from its content
- For any commercial purpose not expressly permitted by these Terms
- In any way that could damage our reputation or business
8. Intellectual Property Rights
8.1 Our Property
All content, features and functionality of the App — including the software code, the 3D folding engine, the lesson and fold-sequence data files, the step notes and written instruction, the user interface design, graphics, icons and branding — are owned by Binaryscript Private Limited and protected by Indian and international copyright, trademark and other intellectual property laws.
8.2 Trademarks
"Origami 3D" and associated logos are trademarks of Binaryscript Private Limited. You may not use them without our prior written permission.
8.3 Third-Party Components
The App includes open-source components, including the three.js 3D library. Those components remain subject to their own licences, which are respected and do not affect your obligations under these Terms.
8.4 Feedback
If you send us feedback, suggestions or ideas about the App, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use and incorporate them without obligation to you.
9. Disclaimer of Warranties
9.1 "AS IS" and "AS AVAILABLE"
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT.
9.2 Instructional Content
The App is an educational tool. We do not warrant that following its instructions will produce any particular result, that every fold sequence is free of error, or that a model will succeed with any given paper. Folding is a manual skill and outcomes depend on you, your paper and your practice.
9.3 Safety
Folding paper involves handling paper and, in some cases, scissors or a cutting tool to obtain a square sheet. You are responsible for your own safety and for supervising any child using the App. Paper edges can cut. We are not liable for injury arising from your use of tools or materials.
9.4 No Advice
Nothing in the App constitutes professional advice of any kind.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BINARYSCRIPT PRIVATE LIMITED AND ITS DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROGRESS, PROFITS OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (b) INR 1,000.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Indemnification
You agree to indemnify and hold harmless Binaryscript Private Limited and its directors, employees and agents from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
12.1 By You
You may stop using the App at any time by uninstalling it.
12.2 By Us
We may suspend or terminate your licence to use the App at any time, without notice, if you breach these Terms.
12.3 Effect
On termination, your licence ends and you must stop using and delete the App. Sections 5, 8, 9, 10, 11 and 14 survive termination.
13. Third-Party Services and App Stores
13.1 Google Play
Your download and use of the App is also subject to the Google Play Terms of Service. Google is not a party to these Terms and has no obligation to provide support for the App.
13.2 Apple App Store
If you obtained the App from the Apple App Store: these Terms are between you and us only, not with Apple; Apple has no obligation to provide maintenance or support; in the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and Apple has no other warranty obligation; Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability, legal compliance and intellectual property claims; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13.3 Google Firebase
The App uses Google Analytics for Firebase and Firebase Crashlytics, as described in the Privacy Policy. Those services are governed by Google's own terms and privacy policy.
14. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the App is subject to the exclusive jurisdiction of the courts in Raipur, Chhattisgarh, India.
15. General
15.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.
15.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
15.3 No Waiver
Our failure to enforce any right or provision is not a waiver of it.
15.4 Assignment
You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
15.5 Changes to These Terms
We may update these Terms from time to time. Changes take effect when published, and the "Last Updated" date above will change. Your continued use of the App after an update constitutes acceptance.
