Agreement to Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("User", "you", or "your") and Binaryscript Private Limited ("Company", "we", "us", or "our") concerning your access to and use of the Stargazing Map mobile application (the "App").
BY DOWNLOADING, INSTALLING OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.
1. Eligibility
1.1 Age
The App is not directed at children under 13. If you are under 18, you should use the App with the involvement of a parent or guardian.
1.2 Legal Capacity
By using the App you confirm you have the legal capacity to enter into these Terms, or that a parent or guardian has agreed to them on your behalf.
1.3 Compliance
You agree to use the App in compliance with all laws applicable to you.
2. Licence to Use the App
2.1 Grant of Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal, non-commercial use.
2.2 Restrictions
You may not:
- Copy, modify, adapt or create derivative works of the App
- Reverse engineer, decompile or disassemble the App, except to the extent this restriction is prohibited by applicable law
- Rent, lease, lend, sell, sublicense or otherwise transfer the App
- Remove or alter any copyright, trademark or attribution notice, including the attribution required by the data licences described in Section 8.3
- Use the App to build a competing product
- Use automated means to extract the App's data files in bulk
Note that Section 8.3 grants you rights over the astronomical data that these restrictions do not remove. Where the two appear to conflict, the data licence governs the data.
2.3 Ownership
The App, including its code, interface, artwork and the arrangement of its content, remains our property or that of our licensors. This licence grants you no ownership.
3. The App and Its Content
3.1 What the App Is
The App is an offline star map. It renders the positions of stars, constellation figures, deep-sky objects, the Sun, the Moon and the planets for a given time and place, and orients that view using your device's compass and motion sensors.
3.2 Free of Charge
The App is currently provided free of charge, with no advertising and no in-app purchases. See Section 4 regarding possible future paid features.
3.3 Accuracy — Read This
The App computes astronomical positions using well-established published algorithms, and its calculations are verified against reference values. It is nonetheless a consumer application and not a professional or navigational instrument.
In particular:
- Object positions are drawn where the calculations place them; where the sky appears on your screen depends on your device's compass, which is subject to drift, local magnetic interference and calibration error. A compass error of several degrees is normal and is by far the largest source of inaccuracy.
- Planetary positions use approximate orbital elements accurate to within about ten arcminutes for the outer planets, which is far below what a handheld device can point to but is not observatory-grade.
- Rise, set and twilight times are computed for a flat, unobstructed horizon at sea level, and take no account of terrain, buildings or altitude.
THE APP MUST NOT BE USED FOR NAVIGATION, SURVEYING, AVIATION, MARITIME USE, OR ANY PURPOSE WHERE AN ERROR COULD CAUSE HARM OR LOSS.
3.4 Sensors and Physical Safety
Using the App involves holding a device up and looking at a screen, often outdoors in the dark. You are responsible for your own safety and surroundings. Do not use the App while driving, cycling, or walking in traffic, near water, near cliffs or drops, or anywhere your attention is needed elsewhere.
NEVER USE THE APP AS A GUIDE TO LOOKING AT THE SUN. The App displays the Sun's position because it is part of the sky and because knowing where it is matters for working out when darkness falls. Looking directly at the Sun, with or without optical aid, can cause permanent blindness. Pointing a telescope or binoculars at the Sun without a proper solar filter can blind you instantly.
3.5 Location
The App works best with an approximate idea of where you are, but does not require it. If you decline the location permission the App uses a default location and tells you so; you may set a location manually at any time. See the Privacy Policy for what happens to that information — in short, it stays on your device.
3.6 Changes to the App
We may add, change or remove features at any time. Because the entire catalogue ships inside the App, corrections to astronomical data reach you only through a new release, and the App may prompt you to install one.
3.7 No Warranty of Availability
The App works offline and does not depend on our servers to function. The analytics, crash reporting and version-check services it uses are provided by Google and may be unavailable at times; this does not affect your ability to use the App.
4. Future Paid Features
The App is free. It contains the technical groundwork for optional paid features, but none is offered at present and nothing in the App is currently locked.
If paid features are introduced:
4.1 Billing
All payments would be processed by Google Play or the Apple App Store under their own terms. We would never receive or store your payment details.
4.2 Scope
The App as you have it today would remain available. Any paid feature would be an addition, not the removal of something you already use.
4.3 Price Changes
Prices, where they exist, may change. Changes would apply only to purchases made after the change.
4.4 Refunds
All purchases would be final and non-refundable. We do not process refunds directly; any refund granted for a store purchase is at Google's or Apple's sole discretion, under that store's own refund policy. Full details are set out in our Refund Policy, which forms part of these Terms.
5. Your Data
5.1 No Account
The App has no account system. Nothing you do in it is tied to an identity.
5.2 Local Storage
Your observing location, settings and usage counters are stored on your device only.
5.3 Data Loss
Because that data exists only on your device and is never backed up by us, clearing the App's data, uninstalling the App, or losing or resetting the device will lose it permanently. We cannot restore it. The consequence is small — you would set your location again — but you should know it.
5.4 Analytics and Crash Reporting
The App sends anonymous usage statistics and crash reports, as described in the Privacy Policy. Your location, your searches and the names of objects you look at are never included.
6. Update and Rating Prompts
6.1 Update Prompts
The App checks whether a newer version has been published and may prompt you to install it. In rare cases — a serious defect, or an error in the astronomical data — a version may be marked as no longer usable, and the App will require an update before it will continue. We will use this sparingly and only where continuing to use an old version would give you results we know to be wrong.
6.2 Rating Prompts
After you have used the App enough to have formed a view, it may ask your device's app store to show its own rate-this-app prompt. This is the store's dialog, not ours; we cannot see whether it appeared or what you did with it, and the store limits how often it may be shown.
7. Prohibited Uses
You may not use the App to:
- Violate any law or regulation
- Infringe anyone's intellectual property rights
- Distribute malware or interfere with the App's operation
- Attempt to gain unauthorised access to any system
- Extract the App's data files for redistribution outside the terms of the data licences in Section 8.3
- Misrepresent the App's output as professional astronomical or navigational data
8. Intellectual Property Rights
8.1 Our Property
The App's source code, interface design, artwork, icon and written content are owned by us and protected by copyright and other laws.
8.2 Trademarks
"Stargazing Map" and "Binaryscript" are our trademarks. You may not use them without written permission.
8.3 Astronomical Data — Third-Party, Openly Licensed
The star, constellation and deep-sky data in the App is not ours. It comes from three open catalogues, each licensed under the Creative Commons Attribution-ShareAlike 4.0 International Licence (CC BY-SA 4.0):
- HYG Stellar Database v4.4 — David Nash (astronexus)
- Stellarium modern sky culture, including IAU constellation boundary data by Pascal Barbier — the Stellarium project
- OpenNGC — Mattia Verga
We comply with that licence by attributing each source in the App and in its documentation. The catalogue files the App ships are adapted material under CC BY-SA 4.0 and are available under that licence on request to [email protected]. The App's own source code is a separate work and is not licensed under CC BY-SA. The full text of the licence is at https://creativecommons.org/licenses/by-sa/4.0/.
8.4 Third-Party Components
The App uses open-source software components under their respective licences.
8.5 Feedback
If you send us suggestions, we may use them without obligation or compensation.
9. Disclaimer of Warranties
9.1 "AS IS" and "AS AVAILABLE"
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
9.2 No Guarantee of Accuracy
WITHOUT LIMITING THE ABOVE, WE DO NOT WARRANT THAT THE ASTRONOMICAL POSITIONS, RISE AND SET TIMES, OR ORIENTATION SHOWN BY THE APP ARE ACCURATE, COMPLETE OR FIT FOR ANY PARTICULAR PURPOSE. SEE SECTION 3.3.
9.3 Device Variation
We do not warrant that the App will work identically on every device. Compass and motion sensor quality varies enormously between handsets, and some devices have no magnetometer at all.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE APP (WHICH IS CURRENTLY NOTHING) OR INR 1,000.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. Where that is the case, the above applies to the fullest extent permitted, and nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
11. Indemnification
You agree to indemnify and hold us harmless from any claim arising out of your use of the App, your violation of these Terms, or your violation of any rights of another party.
12. Termination
12.1 By You
Uninstall the App at any time. That ends this agreement.
12.2 By Us
We may suspend or terminate your licence if you breach these Terms.
12.3 Effect
On termination, the licence in Section 2 ends and you must stop using the App. Sections 8 through 11 survive.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles.
13.2 Jurisdiction
The courts of India shall have exclusive jurisdiction over any dispute arising from these Terms, subject to any mandatory consumer protection rights you have in your country of residence.
13.3 Informal Resolution First
Before starting formal proceedings, please contact [email protected]. Most issues are resolved that way.
14. App Store Terms
The App is distributed through Google Play, and your use is also subject to Google Play's terms. Google is not a party to these Terms, has no obligation to provide support for the App, and is not responsible for it. Where these Terms conflict with the app store's terms, the app store's terms govern the distribution relationship. The same applies to any other store through which the App is later distributed, including the Apple App Store.
15. General
15.1 Entire Agreement
These Terms and the Privacy Policy are the entire agreement between you and us concerning the App.
15.2 Severability
If any provision is held unenforceable, the rest remains in effect.
15.3 No Waiver
Failure to enforce any provision is not a waiver of it.
15.4 Assignment
You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
15.5 Changes to These Terms
We may update these Terms. Changes will be posted with an updated "Last Updated" date, and material changes will be noted in the release notes of the version that introduces them. Continuing to use the App after a change means you accept it.
