Terms of Service for Auto Driver

1. Agreement

These Terms of Service (the "Terms") are a binding agreement between you and Binaryscript Private Limited ("Binaryscript", "we", "us", "our") governing your download, installation, and use of the "Auto Driver" Android application (the "App").

By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not install or use the App.

2. Who Can Use the App

You may use the App only if:

  • (a) you are at least 18 years old;
  • (b) you are legally permitted to drive for hire in your jurisdiction; and
  • (c) you are not barred from using software of this kind under any applicable law or by a competent authority.

The App is a tool for professional and gig-economy drivers. It is not intended for minors.

3. What the App Is and What It Is Not

The App reads ride-request screens from supported rideshare applications and grades the offer to help you decide whether to accept it. It uses Android Accessibility Services and screen capture (MediaProjection) only for this narrow purpose.

The App is not affiliated with, sponsored by, or endorsed by Uber, Lyft, Ola, Careem, or any rideshare platform. Trademarks and service marks belonging to those companies are the property of their respective owners. The App relies on the visible layout of rideshare app screens; if a rideshare app changes its layout, the App may temporarily be unable to grade offers from that app until we update it.

The App's grades and earnings estimates are informational only. They are based on the fare, distance, and time values shown by the rideshare app and on the thresholds you configure. They are not a guarantee of profitability, earnings, or the quality of any ride. You remain solely responsible for every decision to accept or decline a trip.

4. Licence

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use the App on Android devices that you own or control, solely for your own use as a rideshare driver. All rights not expressly granted are reserved.

5. Subscriptions, Free Trial, and Billing

5.1 Subscription

Some features of the App are available only with an active paid subscription ("Subscription"). Subscriptions are billed on a recurring monthly basis through Google Play Billing.

5.2 Free trial

Your first Subscription includes a seven (7) day free trial. During the trial period you will not be charged. If you do not cancel at least 24 hours before the end of the trial, Google Play will automatically charge you for the first paid month and your Subscription will continue on a monthly recurring basis.

5.3 Automatic renewal

Subscriptions renew automatically each month at the price shown at the time of purchase (plus applicable taxes) unless you cancel before the next renewal date. The renewal is processed by Google Play Billing.

5.4 Cancellation

You can cancel your Subscription at any time in the Google Play Store, under "Subscriptions". Cancellation takes effect at the end of the current billing period. You keep access to paid features until that date.

5.5 Refunds

Payments are handled by Google. Refund requests are governed by Google Play's refund policy. Except where required by applicable consumer-protection law, we do not offer refunds separately from Google.

5.6 Price changes

We may change Subscription prices. If we do, we will notify you through the Play Store listing or inside the App before the change applies to your Subscription, and you will have the opportunity to cancel before the new price takes effect.

6. Permissions and Device Access

Using the App requires you to grant certain Android permissions (Accessibility, draw-over-other-apps, notifications, battery-optimization exemption, screen capture, and — only if you enable Secret Camera — camera and microphone). You may revoke any permission in Android Settings at any time; some features will not function without the corresponding permission. Details of what each permission is used for are in the Privacy Policy.

7. Acceptable Use

You agree not to:

  • (a) use the App to violate the terms of service, community guidelines, or driver agreements of any rideshare platform;
  • (b) use the App for any unlawful purpose, including recording audio or video where such recording is not permitted;
  • (c) reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent the law allows you to do so notwithstanding this restriction;
  • (d) remove, alter, or obscure any copyright, trademark, or other proprietary notice;
  • (e) resell, sublicense, or redistribute the App or any part of it;
  • (f) use the App in a manner that could damage, disable, overburden, or impair any server, network, or service; or
  • (g) use any automated means, other than those made available by the App itself, to access or interact with the App.

8. Use of Accessibility Services

Android Accessibility Services are powerful and are primarily designed to help users with disabilities. The App uses them only to detect when a supported rideshare application displays a ride-request screen. The App does not read content from any other application, does not record what you type, does not capture passwords, and does not log keystrokes. You may disable the Accessibility Service at any time in Android Settings; the Cherry Picker feature will then stop working until you enable it again.

9. Driver Safety

The App is a driving-adjacent tool. You are solely responsible for operating your vehicle safely and for complying with all traffic laws and local regulations. Do not interact with the App, your phone, or any overlay while your vehicle is in motion except in a manner that is legal and safe for the jurisdiction you are driving in. We disclaim all liability for accidents, injury, or damage arising from distracted driving or from your use of the App while operating a vehicle.

10. Secret Camera and Recording Laws

If you enable the Secret Camera feature, you are solely responsible for complying with all applicable laws on audio and video recording in your jurisdiction, including laws that require the consent of recorded parties (for example, "two-party consent" rules for audio in parts of the United States and equivalent rules elsewhere). We provide the feature; you decide when, where, and whether to use it, and you bear all legal responsibility for that decision. We recommend you display a clear notice to passengers that recording may be in progress, where required.

11. Intellectual Property

The App, including its code, design, user interface, graphics, icons, text, and trademarks, is owned by Binaryscript Private Limited or its licensors and is protected by copyright, trademark, and other laws. Except for the licence granted in Section 4, no rights are transferred to you.

12. Third-Party Services

The App integrates with Google Firebase (Analytics and Crashlytics) and Google Play Billing. Your use of those services is also governed by Google's terms and policies. We are not responsible for the acts, omissions, or content of any third-party service.

13. Updates

We may release updates to the App from time to time. Updates may add features, remove features, change how features work, or fix defects. Where Google Play auto-updates the App, those updates are delivered by Google Play and governed by its terms.

14. Disclaimers

To the fullest extent permitted by law, the App is provided "as is" and "as available". We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or the accuracy, completeness, timeliness, or reliability of any information displayed by the App. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that grades, earnings estimates, or other outputs are accurate for any ride or any period.

15. Limitation of Liability

To the fullest extent permitted by law, in no event will Binaryscript, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunities, arising out of or in connection with your use of the App, whether based on contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or in connection with the App or these Terms is limited to the amount you paid us for the App (through Google Play Billing) during the twelve (12) months immediately preceding the event giving rise to the claim, or INR 1,000, whichever is greater.

Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.

16. Indemnity

You agree to defend, indemnify, and hold harmless Binaryscript and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your use of the App, (b) your violation of these Terms, (c) your violation of any law or any third-party right (including any rideshare platform's terms of service, and including any recording-law violation arising from your use of Secret Camera).

17. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App or to any paid feature if we reasonably believe you have violated these Terms, or if we are required to do so by law. Sections that by their nature should survive termination (including Sections 11, 14, 15, 16, 18, and 19) will survive.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. Subject to any mandatory consumer-protection laws in your jurisdiction that cannot be waived, the courts at New Delhi, India, have exclusive jurisdiction to resolve any dispute arising out of or in connection with these Terms or the App.

If you are a consumer resident in the European Economic Area, the United Kingdom, or any other jurisdiction whose laws give you the right to bring proceedings in the courts of your place of residence, nothing in this section takes that right away.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top and, for material changes, we will give you notice inside the App or on the Play Store listing. Your continued use of the App after a change becomes effective means you accept the updated Terms. If you do not agree, you must stop using the App.
